Count
The
title passed from father to son until Guido de Ribera, the 5th Baron di San
Paolino died without issue. The title was then succeeded by his sister’s
son, Chev. Alberto Montalto de Ribera. His heir was Maria Antonia , who became Baroness di Benwarrad and San Paolino, and married Dr. Guiseppe Attard M.D, created one of Malta’s finest families in the 19th Century, the Attard-Montalto’s. The succession from Maria Antonia’s son Angiolino to his son Guiseppe in 1892, deceased in 1935 with no sons. The title of San Paolino under Italian law, was to be succeeded by male descendants only. This title was never recognised by Maltese Law, though the change in the Italian Law in 1926, meant that Maria Angela Attard Montalto was to succeed in the Maltese Barony of Benwarrad, and her cousin to the Sicilian Title of San Paolino. The
descendants of Paolino dei Baroni Attard Montalto, the brother of the 7th Barone
di Benwarrad were to succeed as Barons of San Paolino. The title of San Paolino will remain under the Attard-Montalto name until extinction. Some historian, shows the present Baroness di Benwarrad as the Baroness di San Paolino, this is incorrect under the change to the Italian law of Nobility covering all territories that the then Kingdom of Italy was reigning on in 1926. de Ribera, 1st Barone di San Paolino, (Cr:1683-Sicily), with issue Footnote: The title of Barone di San Paolino was on the 16th July 1638 conferred upon Matteo De Ribera, with succession to one of his descendants, by letters patent issued at Palermo, by the President and Captain-General of Sicily, by authority vested in him by Philip IV. King of Spain and Sicily. At Maltese Law this title is only a foreign title and, as such, it can be considered for the purposes of precedence in Malta only if registration or Magistral recognition has been achieved in accordance with the rules of 1739 and 1795 as enacted by Grand Masters Despuig and Rohan. In this case, this title granted to de Ribrera was never registered in Malta, nor does it appear to have received direct recognition for the Grand Masters who ruled Malta. (See:- Correspondence and Report of the Commission appointed to enquire into the claims and grievances of the Maltese Nobility, May 1878, presented to both Houses of Parliament by Command of Her Majesty (C.-2033.) (See Report Paras. 225-226). This does not render the title invalid but in accordance with the rule cited above, although the title is valid, it does not enjoy precedence in Malta.

with issue (Full detail of descendants see Benwarrad). Footnote: It appears that in terms of Sicilian law of the time, a woman was entitled to succeed a title of nobility in her own right. On this basis, Maria Antonia Attard nee Montalto de Ribera, who was the then primogenial descendant was entitled to succeed this title with consequent ulterior transmission. This law was however changed after Maria Antonia’s death by the new monarchy of a unified Italy (see footnote below).

with issue Footnote: Some published sources indicate this lady Maria Angela Attard Montalto as “Baroness of San Paolino”, in addition to her lawful “Baroness of Benwarrad”. However it is clear that as her father died in 1935, that she was in terms of new legislation (year 1926) of a unified Italy not entitled to succeed as Baronessa di San Paolino. In terms of the Statuto delle succesioni ai titoli e agli attrbuti nobiliari (Regio Decreto 16 agosto 1926, n. 1489 article 2 reads: Le successione nei titoli nobiliari e anessi predicate ha luogo a favore dell' agnazione maschile dell’ ultimo investito per ordine di primogenitura, senza limitazione di gradi, con preferenza della linea sul grado. I chiamati alla successione devono descendere per maschi dallo stipite comune, primo investito del titolo. I titoli non si trasmettono alle femmine, ne per linea femminile, salvo quanto dispone il primo capoverso dell’ art. 4 . The latter capoverso reads “Quelli concessi, oltre che tutti I maschi, anche alle femmine, spettano allo medesime solo durante lo stato nubile e non danno luogo a successione.Article 5 reads: I titoli provenienti da femmine, che, alla entrata in vigore delli presenti disposizioni sono legittimamente pervenuti alla lora discendenza maschile, continuano aa devolversi alla medesima discendenza, secondo le norme stabilite nell’ art. 2. Estinte le linee maschili, aventi per stipite comune la femmina intestataria del titolo, questo con gli annessi predicati ritorna, preview patenti di Regio assenso, all' agnazione maschile della famiglia, alla quale apparteneva nel giorno della promulgazione delle leggi abolitive della feudalita, osservate le norme stabilite nell’ art. 2

However on the basis of the genealogical charts, and the change in Italian law, the said Josie Attard Montalto succeeds Giuseppe Attard Montalto. Footnote#2: Some time later in 1943, further Italian legislation was enacted. In terms of the Ordinamento dello Stato nobiliare italiano (Regio Decreto 7 giugno 1943, n.651) article 40 reads: Le successioni dei titoli, predicate e attribute nobiliari hanno luogo a favore della agnazione maschile dell’ ultimo investito, per ordine di primogenitura senza limitazione di gradi con preferenza della linea sul grado. I chiamati alla successione debono discendere per maschi dallo stipite commune, primo investito del titolo. I titoli, I predicate e gli attributi nobbiliari non so trasmettono per linea femminile, salvo quanto dispone il primo capoverso dell’ art. 45.
